The Business Skills Migration (BSM) program underwent some major changes from the 1st of March 2003 when the Australian Immigration Department introduced the two-stage policy.

Under the two-stage arrangements, business migrants are granted a Business Skills (Provisional) visa for four years and, after establishing the requisite level of business or maintaining their eligible investment, are eligible to make an application for a Business Skills (Residence) visa.

A direct permanent residence category will still be available for high-calibre business migrants sponsored by State/Territory governments. This is known as the Business Talent visa-subclass 132.

Subclass 160 BUSINESS OWNER VISA (Provisional)
About this Visa
This visa is for people who have a successful business career, and have a genuine and realistic commitment to be involved as an owner in a new or existing business in Australia. This visa is also the first step towards being granted a permanent Business Skills visa.

Who is this visa for?
This visa is for business owners from overseas who intend to own a business in Australia, and are less than 45 years of age and have vocational English.

To apply for this visa types, applicants must:
 
* Have a successful business career.
* Have at least 10% ownership interest.
* Have at least AUD$200,000 invested in a business, or working in a publicly listed company with at least 10% of shareholding.
* Have net assets of at least AUD$500,000 lawfully acquired and capable of being transferred to Australia within two years.
* Have annual turnover of at least AUD$500,000 for at least two out of last four fiscal years.
* Should be involved in the day-to-day management and control of the overseas business.
* Genuine intention to establish or participate in active management of qualifying business in Australian and realistic commitment to maintain substantial ownership interest.
* Have sufficient net assets to settle in Australia.
* Have notified appropriate regional authority in state/territory regarding applicant and business intention in Australia.
* No history of unacceptable business activities.
* Demonstrate need to be in Australia to conduct or establish business activity in Australia.

Subclass 161 SENIOR EXECUTIVE VISA (Provisional)
About this Visa
This visa is for senior executive employees of major overseas businesses, who have significant net assets and a genuine and realistic commitment to participate in the management of a new or existing business. This visa is also the first step towards being granted a permanent Business Skills visa.

Who is this visa for?
Senior executives from overseas who through their experience have gained the skills to successfully manage a business in Australia, are less than 45 years old, and have vocational English.

To apply for this visa types, applicants must:
 
* Have a successful business career.
* Have net assets of at least AUD$500,000, are lawfully acquired and capable of being transferred to Australia within two years.
* Have sufficient net assets to settle in Australia.
* For at least two out of four fiscal years immediately before the application is made, applicant has occupied a position in three of the highest management levels and is responsible for strategic policy development in major business AUD$50 million turnover.
* Has notified appropriate regional authority in state/territory regarding applicant and business intentions in Australia.
* Genuine intention to establish or participate in active management of qualifying business in Australian and realistic commitment to maintain substantial ownership interest.
* No history of unacceptable business activities.
* Demonstrate the need to be in Australia to conduct or establish business activity in Australia.

Subclass 162 INVESTOR VISA (Provisional)
About this Visa
This visa is for people who have a successful business or investment career, and have a genuine and realistic commitment to be involved in investing or business in Australia. This visa is also the first step towards being granted a permanent Business Skills visa.

Who is this visa for?
This visa is for investors/business people from overseas who are willing to invest funds in a designated investment in Australia for four (4) years, and are less than 45 years of age and have vocational Enlish.

To apply for this visa types, applicants must:
 
* Have overall successful qualifying business activity or eligible investment activity.
* Have a business and personal assets of at least AUD$2,250,000 throughout two fiscal years before the applications are made.
* Have sufficient net assets to settle in Australia.
* For at least one of five fiscal years immediately before the application is made, applicant has direct management in qualifying business where applicant and/or spouse have 10% ownership or net value of at least AUD$1,500,000.
* For at least three years applicant must have directly managed one or more qualifying business or eligible investments; and have evidence of high level of management skill in investment/business activity.
* Has notified appropriate regional authority in state/territory regarding applicant and business intention in Australia.
* Genuine intention to maintain business/investment activity. Able to make a designated investment of an amount of AUD$1 500 000.
* No history of unacceptable business activities.

Subclass 163 STATE/TERRITORY SPONSORED BUSINESS OWNER VISA (Provisional)
About this Visa
This visa is for people who have a successful business career, and have a genuine and realistic commitment to be involved as an owner in a new or existing business in Australia. This visa is also the first step towards being granted a permanent Business Skills visa.

Who is this visa for?
This visa is for business owners from overseas who intend to establish or participate in a business in a state or territory where the sponsor is located, the applicants are less than 55 years old and do not have functional English.

To apply for these visa types, applicants must:
 
* Have a successful business career.
* Have a net value of at least AUD$250,000 that is available for the conduct or establishment of a business in Australia, lawfully acquired and available for transfer, and capable of being transferred to Australia within 2 years after the grant of a Subclass 163 visa.
* Have annual turnover of at least AUD$300,000 for at least two out of the last four fiscal years, or demonstrate a sound continuous employment record at a high level of senior management for four years before application or a senior manager.
* Should be involved in the day-to-day management and control of the overseas business.
* Have sufficient net assets to settle in Australia as determined by sponsoring appropriate regional authority.
* Sponsorship by appropriate regional authority required.
* Genuine intention to establish or participate in active management of qualifying business in Australian and realistic commitment to maintain substantial ownership interest.
* No history of unacceptable business activities.
* Demonstrate need to be in Australia to conduct or establish business activity in Australia.

* Sponsorship by appropriate regional authority required.
* Genuine intention to establish or participate in active management of qualifying business in Australian and realistic commitment to maintain substantial ownership interest.
* No history of unacceptable business activities.
* Demonstrate need to be in Australia to conduct or establish business activity in Australia.

Subclass 165 STATE/TERRITORY SPONSORED INVESTOR VISA (Provisional)
About this Visa
This visa is for people who have a successful business or investment career, and have a genuine and realistic commitment to be involved in investing or business in Australia. This visa is also the first step towards being granted a permanent Business Skills visa.

Who is this visa for?
This visa is for investors/business people from overseas who are willing to invest funds in a designated investment in Australia for four (4) years, and are less than 55 years of age and do not have functional English.

To apply for this visa types, applicants must:
 
* Overall successful qualifying business activity or eligible investment activity.
* Have business and personal assets of at least AUD$1,125,000 throughout the two fiscal years before the applications were made.
* Have sufficient net assets to settle in Australia as determined by an appropriate regional authority.
* For at least one of five fiscal years immediately before the application is made, applicant has direct management in qualifying business where applicant and/or spouse have 10% ownership or net value of at least AUD$750,000.
* At least three years applicant has directly managed one or more qualifying business or eligible investments; and high level of management skill in investment/business activity evidenced.
* Sponsorship by appropriate regional authority required. Made a designated investment of an amount of AUD$750 000, in the State or Territory where the sponsored applicant is located.
* Genuine intention to maintain business/investment activity.
* No history of unacceptable business activities.

Subclass 457 STATE/TERRITORY SPONSORED INVESTOR VISA (Provisional)
About this Visa

This subclass allows Australian Employers to sponsor overseas skilled workers to work in Australia on a temporary residency visa for a maximum of four years.


Who is this visa for?
Overseas skilled workers who want to work in Australia or the skilled workers who are not eligible to apply for permanent residency visa or whilst waiting for a permanent residency visa to be granted.

To apply for this visa type:
 
* The Australian employers need to demonstrate that the sponsorship has benefits to Australia and are prepared to pay a "Minimum Salary Level".
* he applicants must have personal attributes and employment backgrounds that are consistent with the nature of the employment and have the skills to perform these duties

Subclass 132 BUSINESS TALENT VISA (Residence)
About this Visa
This visa is designed for high caliber business people who are owners or part owners of an overseas business and have a genuine and realistic commitment to participate in the management of a new or existing business in Australia. You must be sponsored by a state or territory government.

Who is this visa for?
This visa is for high caliber business people from overseas who are less than 55 years old, and do not have functional English.

To apply for this visa types, applicants must:
 
* Have a successful business career.
* Have at least AUD$400,000 invested in a business for two out of the last 4 fiscal years before applying.
* Have business and personal assets of at least AUD$1,500,000 capable of being transferred to Australia within two years.
* Have annual turnover of at least AUD$3,000,000 for two out of last four fiscal years.
* Must be sponsored by state/territory government (i.e. Chief Minister, Premier of their delegate).
* Genuine intention to establish or participate in active management of qualifying business in Australia and realistic commitment to maintain substantial ownership interest.
* No history of unacceptable business activities.

This visa is designed to attract business people to assist in the economic development of Australia. The visa allows you to stay in Australia on a permanent basis for the purpose of owning a new or existing business. You must have held one of the required provisional visas and meet the requirements to be eligible for this visa.

Who is this visa for?
Business owners from overseas who have held one of the required provisional visas.

To apply for this visa types, applicants must:
 
* In 1 or more main business/es for at least 2 years.
* Have net assets - business: AUD$100,000 for 12 months.
* Have business and personal assets: AUD$250,000.
* 2 full time employees who are Australian citizens, Australian permanent residents or New Zealand passport holders.
* In 12 months applicant's main business/es have annual turnover of at least AUD$300,000.

About this Visa
This visa is designed to attract business people to assist in the economic development of Australia. The visa allows you to stay in Australia on a permanent basis for the purpose of owning a new or existing business. You must have held one of the qualifying provisional visas, be sponsored by a state/territory authority, and meet the requirements to be eligible for this visa.

Who is this visa for?
People who have an ownership interest in 1 or more actively operating main businesses and are directly involved in managing that business.

To apply for this visa types, applicants must:
 
* In 1 or more main business/es for at least 2 years.
* Meet 2 out of the following 3 conditions unless appropriate regional authority provide waiver:
- Net business assets: AUD$75,000 throughout the period of 12 months ending immediately before the application is made;
- Net business and personal assets: AUD$250,000 throughout the period of 12 months ending immediately before the application is made;
-have 1 full time employee who is an Australian citizen, Australian permanent resident or New Zealand passport holder.
* Had annual turnover of at least AUD$200,000 12 months before the application was made.

Who is this visa for?

The applicants have been residents, as the holders of a Subclass 165 (State/Territory Sponsored Investor (Provisional)) visa, in the State or Territory in which the appropriate regional authority that sponsors the applicant is located for a total of at least 2 years in the 4 years immediately before the application is made.

To apply for this visa types, applicants must:
 
* Continue to maintain business/investment activity in Australia for at least 4 years.
* Neither applicant or spouse has history of unacceptable business activities.
* At least 2 out of 4 years residence in sponsoring state/territory as the holder of an Investor (Provisional) visa immediately before the application is made.
